 Hire Government Staff on Merit : Rajasthan High Court


These days Government across India hiring staff on contract basis, because they have put ban  regular Government jobs. Some States and Central Government are decreasing 10% government job on year to year basis. Therefore, there is a general shortage of Government Staff  in all government departments. Not recruiting regular staff also also minimizes government liabilities on its staff.  If government recruits staff on contract basis, then the employed person work on less payment with less facility and on temporary basis which can be shown the door on any day.



Also there is corruption in this kind of contract basis hiring also. Most companies providing contract staff are related to political leadership or bureaucracy in some or other way. Also on contract basis they are free to recruit any one. no question asked, no responsibility, no written examination. No liability.


This is the practice in most of the state government. But now Rajasthan High Court has tried to  restrained this practice. High court of Rajasthan at Jaipur has given some guidelines in this manner specially to Rajasthan Government.



Rajasthan High Court says hire government staff on merit only.  Rajasthan High Court has restrained the Rajasthan State government from employing people on contract for posts that are permanent. The Court has also imposed a ban on hiring employees through placement agencies.


The court was hearing a petition against the State government’s practice of not giving permanent employment and hiring people on contract to fill up regular vacancies.


The petitioner have  raised a petition against orders to cancel the contract of a placement agency at 10 primary health centres. They had contended that employees were being hired through placement agencies at all other health centres in Rajasthan.


Justice Sanjeev Prakash Sharma ruled that hiring for posts created under Central and State government schemes should be “merit-based” only.


Selection of candidates, even on contract, is to be done through the proper channel, including advertisements and written examinations, said the court.


The court, which has not imposed a blanket ban on hiring employees on contract, has given the State government liberty to constitute a nodal agency and lay down a procedure for the purpose.


Appointments should not be made only on the basis of interviews and the merit list of candidates should show the marks obtained by them, it said.


“Selection [only] through interviews can lead to randomness,” the court observed. 


This is  a far-reaching judgment, it will bring some thinking in the Government job hiring on contract basis.
